In the United States a manufacturer of goods and products to be distributed in commerce has the obligation and responsibility to market safe products. This is a change from caveat emptor ("let the buyer beware") to strict liability for manufacturing defects that make a product unreasonably dangerous.
Under Tort law, a manufacturer is held liable when one of its products, placed on the market with the knowledge that it will be used without inspection for defects, proves to have a defect that causes personal injury or death.
A person who is injured or (his or her estate) killed may have a cause of action against the persons who designed, manufactured, sold, or furnished that product.
