Train Accident Death
All railroads must report as required by regulation all Rail-Equipment Train Accidents to the FRA. The FRA investigates all serious train accidents, including passenger train accidents where there are passengers on board the train, release of hazardous material or if an employee is killed.
FELA DEATH CLAIMS: An employee of a Railroad have unique rights preserved under the Federal Employers Liability Act ("FELA"), a body of laws enacted by the US Congress. FELA has specifically protected railroad workers since the turn of the century, from dangers and hazards associated with their workplace. Under the FELA, an injured railroader is allowed to bring a lawsuit directly against his employer -- he or she is not barred by the Workers Compensation Act as are most workers, and may recover many diverse elements of damages, including pain and suffering and loss of enjoyment of life.
Railroad and train accident death cases present unique and special issues regarding the application of the Federal Employers Liability Act as is pertains to railroad workers. These questions include accidents which occur away from railroad premises, actions involving persons who have been assigned to work by the railroad by their private employers, and accidents which involve people who are not direct employees of the railroad. Often train accident death cases are brought by the families of victims of railroad negligence at railroad crossings, and others who are not railroad employees, yet are injured by railroad negligence.
